Confirmation has been received from the deeds office that when applying for the cancellation of a lost mortgage bond, in terms of Regulation 68(11) of the Deeds Registries Act 47 of 1937, or for the application of a certified copy of a title deed in terms of Regulation 68(1) of the aforesaid Act, it is not peremptory to disclose the property description and extent in the application and affidavit.
However, should this information be disclosed it must be correct and if faulty, could result in a rejection of the said documents It is strongly advised that you refrain from disclosing the particulars of the property description in the aforesaid affidavits to minimise rejections or having clients to re do the oath.
